Terms of Service

1. License grant

Upon purchase, you receive a personal, non-transferable, non-exclusive license to install and use ElkTracker on up to 5 devices. This license is perpetual — it does not expire.

2. Restrictions

You may not: redistribute, resell, sublicense, reverse-engineer (beyond what applicable law permits), or modify ElkTracker. You may not share your license key or license files with others.

3. No-refund policy

All sales are final. Because ElkTracker uses offline license verification built into the device firmware, a purchased license cannot be revoked after activation. A free demo version is available prior to purchase that replicates the full feature set with the exception of saving, loading, and exporting projects. We strongly encourage you to test the demo on your hardware before buying. If you have a pre-purchase question, contact us at hello@tomhay.es.

4. Updates

Your license includes all updates within one full version cycle. The version cycle is defined by the major version number at the time of purchase plus one: purchasing v1.x entitles you to all updates through and including v2.x; purchasing v2.x entitles you through v3.x, and so on. Updates beyond the included cycle are available as a discounted paid upgrade. We make no guarantees about the frequency or content of updates within the included cycle.

5. Disclaimer of warranties

ElkTracker is provided "as is" without warranty of any kind. We do not warrant that it will be error-free or uninterrupted.

6. Limitation of liability

To the maximum extent permitted by law, Tom Hayes shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of ElkTracker.

7. Governing law

These terms are governed by the laws of England and Wales.
